Rummy Jalsa is an online platform provided by ZOVING TECH SOFTWARE SOLUTIONS PVT LTD (referred to as "ZOVING," "Rummy Jalsa," "We," "Us," or "Our"). This platform allows users ("You" or "User") to enjoy the game of Rummy online with others.

These Terms of Service ("Terms"), along with our Privacy Policy, Fair Play Policy, and Game Rules (collectively, "Platform Policies"), govern Your use of Rummy Jalsa's services, including the website, mobile app, and related features ("Services"). By using Our Services, You agree to comply with the Platform Policies. Please read them carefully before proceeding. If You disagree with any part, please discontinue using the Services immediately.

We may update the Platform Policies from time to time at Our sole discretion. Any significant changes will be communicated to You, and Your continued use of the Services will indicate Your acceptance of the updated terms.

If any part of these Terms is deemed invalid or unenforceable by a competent authority in India, the remaining provisions will remain valid and binding.

1. Definitions:

• 1.1 "Applicable Laws": Refers to all relevant legal regulations, statutes, and rules applicable in India, including directives from courts or government authorities.
• 1.2 "Bank Account": Means a financial account maintained with a recognized bank or institution, including e-wallets authorized by the Reserve Bank of India.
• 1.3 "Barred States": Are Indian states where online gaming is prohibited by law.
• 1.4 "Buy-in": Is the amount a User must pay to participate in a Cash Game on the Platform.
• 1.5 "Cash Games": Are Rummy games played for monetary stakes as per the Game Rules.
• 1.6 "Game(s)": Refers to the game of Rummy available on Rummy Jalsa, including variations like Points, Pool, Deals, and Tournaments.
• 1.7 "Platform": Means the Rummy Jalsa website and its mobile/desktop applications where Users can access Games and related services.
• 1.8 "Platform Policies": Include the Terms of Service, Privacy Policy, Fair Play Policy, and Game Rules applicable to Rummy Jalsa.
• 1.9 "Rummy Jalsa Wallet": Is a feature of the User’s Rummy Jalsa Account that allows for depositing, utilizing, and managing funds on the Platform.
• 1.10 "Withdrawable Balance": Refers to the portion of funds in the Rummy Jalsa Wallet that can be transferred to a User’s Bank Account.
• 1.11 "Withdrawal": Is the process of transferring funds from the Withdrawable Balance to a User’s designated Bank Account.
• 1.12 "Refund": Refers to the reversal of payments made by a User (excluding applicable taxes) back to the Rummy Jalsa Account under specific conditions.

2. Who may use Our Services:

Our Services are intended only for individuals aged 18 years or older and are not available to residents of Barred States where online gaming is prohibited by law. By accessing or using Our Services, You confirm that You meet these eligibility criteria.

We reserve the right to verify Your age and location at any time. If You are found to be underage, residing in a Barred State, or otherwise ineligible, We may restrict or terminate Your access to the Services. Furthermore, individuals not legally competent to transact in Indian Rupees through recognized banking channels are prohibited from participating in Cash Games. Any violation of these terms may result in disqualification, forfeiture of winnings, or legal consequences.

3. Usage of Our Services:

• 3.1 Rummy is a game of skill: and is therefore considered legal to play in most Indian states. Our Platform ensures fairness and transparency in gameplay through the use of a Random Number Generator (RNG), certified by iTech Labs, a globally recognized authority.
• 3.2 Data Collection: By using Our Services or creating an account on Rummy Jalsa, You agree to the collection and processing of Your information as outlined in Our Privacy Policy.
• 3.3 Internet Connectivity: While We strive to provide seamless gameplay, interruptions caused by factors such as Your internet connectivity or device issues are beyond Our control.
• 3.4 Winnings and Credits: All winnings and Discount Credits are non-transferable and unique to each player. Any attempt to transfer these will result in forfeiture and may constitute a violation of the Terms.

4. Registration and Account:

• 4.1 Registration Process: To access the full range of features and Services on Rummy Jalsa, You must register by creating a username and password and providing a valid mobile number.
• 4.2 Account Responsibility: You are solely responsible for all activities conducted through Your account.
• 4.3 Confidentiality: It is Your responsibility to maintain the confidentiality of Your account details, including Your username, mobile number, and password.
• 4.4 False Information: You confirm that the information provided during registration is true, accurate, complete, and lawful.

5. Game Formats and Rules:

• 5.1 Game Variations: Rummy Jalsa offers various formats and variations of the game of Rummy, including Cash Games and non-cash Games, which may be adjusted or expanded at Our sole discretion.
• 5.2 Game Rules: By participating in any Game, You agree to abide by the applicable Game Rules, which form part of the Platform Policies.
• 5.3 Winnings: You may win prizes while playing Games on the Platform. The issuance and redemption of such prizes are subject to specific terms and conditions communicated at the time the prize is awarded.
• 5.4 Discrepancies: In the event of any inconsistency between the Game Rules or FAQs available on the Platform and these Terms, these Terms shall take precedence.

6. Restrictions on the use of Our Services:

• 6.1 Prohibited Content: You agree not to upload, distribute, transmit, publish, share, or post any content through Our Services that:
• Belongs to another person without authorization or infringes on any intellectual property rights.
• Is defamatory, obscene, invasive of privacy, harassing, racially or ethnically offensive, or violates applicable laws.
• Contains harmful elements, including but not limited to software viruses or misleading information intended to harm others.
• Threatens the unity, integrity, security, or sovereignty of India or public order, or encourages illegal activity.
• Promotes a competing service, solicits donations, or disparages Us or Our affiliates in any manner.
• Violates any other Applicable Law or Platform Policies.
• 6.2 Suspension of Account: We reserve the right to immediately suspend Your access to communication features or terminate Your account if You engage in any prohibited activity under this Clause.
• 6.3 Reverse Engineering: You shall not reverse engineer, modify, intercept, or emulate Our proprietary communication protocols or attempt to manipulate Our Services or content in any way.
• 6.4 Commercial Use: You shall not use Our Services for commercial purposes, including hosting or network play, or alter, frame, or remove any proprietary notices within the Platform.
• 6.5 Fraudulent Activity: Any fraudulent activity, including using unauthorized payment methods or accessing another’s account, is strictly prohibited.
• 6.6 Account Transfer: You shall not transfer, sell, or trade Your account, virtual currency, rewards, or any other attributes related to Our Services.
• 6.7 External Assistance: External assistance in playing Games, account sharing, or engaging in activities like money laundering or deliberately losing Games is strictly prohibited.
• 6.8 Spamming: Spamming or sending unsolicited communications to other users is not permitted.

7. Deposit, Payment, Withdrawal, Refund, and Cancellation:

• 7.1 Deposit: All payments on the Platform must be made through Your Wallet in Indian Rupees (INR). Deposited funds are credited to the Deposit Balance Segment and can be transferred to the Game Balance Segment for participating in Cash Games.
• 7.2 Withdrawal: Withdrawable Balance can be transferred to Your bank account or partially to the Game Balance Segment per promotional offers. Withdrawals are subject to KYC verification and security checks.
• 7.3 Refund: Unutilized funds in the Deposit Balance Segment can be refunded upon request, subject to KYC completion. Refunds will be credited to the original source within two weeks of the request.
• 7.4 Cancellations and Compliance: Refund policies for cancelled Cash Games are as specified on the Platform. Winnings may be disclosed to authorities, and taxes may be withheld as required by law.

8. KYC Verification:

• 8.1 When KYC is Required: You are required to complete the KYC (Know Your Customer) verification process in the following cases:
• When placing a Withdrawal Request.
• If there is suspicion of or notification regarding a violation of Platform Policies.
• If You breach applicable deposit limits.
• To claim winnings or promotional offers, as required by Applicable Laws.
• At Our discretion, based on specific circumstances.
• 8.2 KYC Process: You must upload valid documents via Our Platform, including Your Permanent Account Number (PAN) and Bank Account details.
• 8.3 Submission Guidelines: Documents must be clear, legible, and uploaded in JPG, JPEG, or PDF format.
• 8.4 Processing and Notification: KYC verification may take up to 3 working days. We reserve the right to validate and/or reject the KYC documents at our sole discretion.

9. Discount Credits:

• 9.1 Allocation of Discount Credits: Discount Credits may be offered at Our sole discretion when You add cash to the Deposit Segment, make a Withdrawal request, or participate in promotional offers.
• 9.2 Usage Conditions: Discount Credits can only be applied toward Discounted Buy-ins for Cash Games and may have specific restrictions, including usage limited to certain types of Games.
• 9.3 Transparency: Before initiating a Cash Game, details about applicable Discount Credits for that Game will be provided in an information panel.
• 9.4 Termination of Account: If Your account is terminated by You or Us under these Terms, all allotted Discount Credits will be cancelled, and You will lose any rights to them.
• 9.5 Policy Violations: Violations of Platform Policies may result in the forfeiture of Discount Credits and other promotional benefits.
• 9.6 Non-Transferability: Discount Credits cannot be redeemed for money, prizes, or transferred to other users. They are non-withdrawable.
• 9.7 Game Participation with Discount Credits: We may offer Games where You can use Discount Credits for entry. Winnings from such Games will also be in the form of Discount Credits.

10. Taxes:

• 10.1 TDS Deduction: Tax Deducted at Source (TDS) will be applied to net winnings as per the rates prescribed by applicable laws. Currently, a 30% TDS rate is levied on net winnings at the time of Withdrawal.
• 10.2 PAN and Aadhaar Compliance: You must ensure Your PAN is valid, linked to Your Aadhaar, and compliant with applicable Income Tax laws.
• 10.3 User Responsibility: Your personal tax obligations and compliance with tax laws are solely Your responsibility.

11. Termination, Suspension, and Opt-out:

• 11.1 Inactive Account Fee: If You do not log in or participate in Games on the Platform for 12 consecutive months, Your account may be deemed inactive. We may charge an annual maintenance fee of up to INR 250.
• 11.2 Suspension or Termination Due to Violations: We may suspend or terminate Your account if You violate Platform Policies or attempt to breach the security of Our Services.
• 11.3 Consequences of Termination: If Your account is terminated for violations, You will be barred from using Our Services linked to the terminated account.
• 11.4 Breach of Security or Privacy: If a security or privacy breach is identified, we may take actions including blocking access to Our Services and permanently terminating Your account.
• 11.5 Fair Play Violations: If You engage in activities deemed to violate Fair Play rules, funds may be forfeited, and compensation up to INR 10,000 per violation may be charged.

12. Your Representations and Warranties:

• 12.1 Eligibility and Information Accuracy: You are legally competent and eligible to participate in Games and transactions on the Platform. Any information You provide is accurate and up-to-date.
• 12.2 Account Security: You will safeguard Your account credentials, including Your password.
• 12.3 Intellectual Property Compliance: You have the necessary rights to any content You upload or share on the Platform, and such actions will not infringe on third-party intellectual property rights.
• 12.4 Lawful Use: You will use Your account solely for playing Games and not for any unlawful or prohibited activity, including but not limited to money laundering.

13. Content and Advertisements:

• 13.1 User-Generated Content: You grant Us a royalty-free, perpetual, worldwide, non-exclusive, and transferable license to use Your content in marketing materials.
• 13.2 Exposure to Third-Party Content: By using Our Services, You may encounter content shared by other users over which We have no control.
• 13.3 Promoted and Sponsored Content: Our Platform may feature promoted or sponsored content, including links to third-party sites.

14. Disclaimer, Indemnity, and Limitation of Liability:

• 14.1 Disclaimer of Liability: We are not liable for any claims, losses, injuries, damages, expenses, or lost profits arising from Your use of the Platform or Services.
• 14.2 Limitation of Liability: Our maximum liability for all claims against Us, excluding valid Withdrawal requests, is limited to the Platform Charges paid by You over the preceding three (3) months.

15. Intellectual Property Rights:

• 15.1 Ownership of Intellectual Property: We and our affiliates exclusively own all rights to the Platform and Services, including patents, trademarks, copyrights, software, and other intellectual property.

16. Complaints and Disputes:

• 16.1 Complaint Resolution: If You have any complaints or grievances, please contact our customer care team for resolution.
• 16.2 Confidentiality of Disputes: You agree that all complaints and disputes at Rummy Jalsa are confidential.

17. Governing Law, Dispute Resolution, and Jurisdiction:

• 17.1 Governing Law: The Platform Policies are governed by and shall be interpreted under the laws of India.
• 17.2 Jurisdiction: Any dispute arising from these Platform Policies shall be subject to the exclusive jurisdiction of the civil courts in Bengaluru, Karnataka.

• 18.1 Responsible Gaming Policy: Rummy Jalsa prioritizes Your health and well-being, and we continually take steps to enhance the overall experience for our users. We encourage You to adhere to Our Responsible Gaming Policy.
